single or married file separately

Post by eliot »

I am canadian working in the US for less than 183 days in 2008. My wife is still in Canada and doesn't have a SSN or ITIN. I think I should use 1040NR forms. But on my Federal and Illinois return, should I file as "single" or "Married file separately"?

Many thanks!

You cannot file "single", you are mariied.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Nelsona, thank you for your reply.

But how do I fill the "Spouse's Social Security Number" in IL-1040 form? My wife doesn't have SSN.

She will be issued ITIN when you list her as your spouse on 1040, and file W-7

I am going to file 1040NR-EZ. No spouse information in this form. Does that mean that my wife doesn't need a ITIN?

Thank you

Tip: never use the simple returns, all they do is remove deductions and credits from you. Use 1040NR and get an ITIN for spouse.
