You obviously won't get an endorsement of anyone other than the person running this site.

Besides, it is not necessary in this day and age to go to an office.

We have dealt with all issues on this forum, with at least a dozen living near you; what's your questions.

Being a Canadian citizen, living in Canada and commuting to US for work, do I have to file 1040NR (using 1040 proforma/tax rate) or can I simply file 1040?
Please advise.

You have 3 choices.

1040NR, reporting only US-source income

1040, reporting world income

or, if married, 1040NR on which you report only US income, but calculate the taxrate on that income using a 1040 (married filing jointly).

If I opt for the 3rd option (i.e. filing 1040NR on which you report only US income, but calculate the taxrate on that income using a 1040 MFJ), can I claim property taxes and mortgage interest paid for house located in Canada?

You can clim all the deductions etc on the 'fake' 1040, and then use the rate on 1040NR.

I believ you could have used mortgage interst and prop taxes on normal 1040NR, no?

Do I have to send the "fake" 1040 form with my returns as well?

If I file using either 1040NR or 1040, do I have to send form 8833 (to claim treaty status) as well?

The 1040NR has sufficient space to indicate various treaty articles right on the form (there are at least 2 questions which ask it).

If you file an Article XXV return, it would be wise to include an 8833, just to let them know what you are doing.

When I file 1040NR (using taxrate from 1040), should I label the "fake" 1040 performa as "fake" (or strike out as 'void' or something of imilar nature)? other wise, how'd they know which one to process, 1040 or 1040NR.

Please advise.

Well, you won't really complete the 1040 (after all your 1040 and 1040NR won't have the same income), but you will complete the 1040NR.

Your 8833 will explain what you are doing.

You can write "Pro Forma 1040 for XXV(4) calculation"
