My relevant details:

1) Foreign Citizen (Not American)

2) Arrived in Canada on August 1 on a work permit

3) In 2008, my total duration of stay in Canada would be 5 months

4) I have been traveling to US on business visits and anticipate more work related visits to US before the end of 2008.

Can I file as a non resident for 2008 and get a refund on the taxes (on the fedral and provincial taxes) ?

Once you arrived in Canada, and presumably got a Cdn job, you became resident on that day. It is not the number of days that matters. This would be true if you moved january 2nd or December 30th.

You yourself said it: you are only visiting the US on business. You live in Canada.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
