T1161

Post by April »

Hello,

Just wondering if i should have filed T1161 for my house, for tax year 2017... here is my case:

left Canada Nov 2011 (sold house prior, did not file T1161)
moved back to Canada July 2015 (bought a house Dec 2015)
left Canada Aug 2017 (did not sell house)
moved back to Canada Oct 2019 (still own that house)

This is stated as an exclusion on the T1161 form:
3) property you owned when you last became a resident of Canada, or property you inherited after you last became a resident
of Canada, if you were a resident of Canada for 60 months or less during the 10-year period before you emigrated and the
property is not taxable Canadian property

Thank you for your input

Cdn real estate is taxable Cdn properryy, so the exclusion doesn;t apply. You should have listed all your possessions that meet the criteria of T1161, including any Cn real estate you had.
nelsona non grata. Non pro. Please Search previous posts, no situation is unique as you might think. Happy Browsing :D
