First Year Tax Filing - Canadian Working in US on TN Visa

Post by TAXED »

Hi Everyone,

Let me start by saying that this a great site to understand how to file your cross boarder taxes.

I have read lot of posts, read the post for about 7 hours and gained lot of valuable information. I however have a few question as my situation is a different ( you guys knew it was coming ).

I got a TN visa in October and moved to US in end of October. While I was in US i was still working for my old canadian employer full time. My last day with Canadian employer was in mid Dec. So I was getting paid by both US and Canadian firm till mid Dec till I resigned with Canadian firm.

I was a fool and thought I only had to do my taxes in Canada since I was a Canadian Citizen unitil someone told me that if I have W2 I need to file my taxes in US as well. Well Now I'm totally confussed. I made an RRSP contribution at the end of the year for $5000.00. I also made RRSP contribution through out the year as my Canadian employer was doing a copay. So a total RRSP contribution of $15,000. $10,000 from my pocket and $5,000 from Canadian employeer.

Here's a twist now, my wife moved to US on Student Visa in March of 2007 and as I said I moved to US in end of October. I did not close any Canadian Bank Accounts or anything. I still have cash in TD and my RRSP with TD and with Standard Life.

I do not want to break my ties with Canada as we have jointly my wife and myself has sponsered her family to Canada. Since she does not have any income we sponsered using my earnings.

Can someone please let me know what kinda mess I'm in and how can I file my US and Cadian Taxes. For US what forms can I use.

I hope this post will cover some of the information that was missed in other posts.

Thank You All.

Not Sure, if my questions were too dumb too to answered or too complicated. Either way some help will be great.

Should I file using 1040 or 1040NR. Can I file as family with my wife who is on F1 and does not have US Social Security Number. Do I need to file any other forms with 1040.

Once again thanks for looking and replying to my post.

Hi Nelsona

Is there a reson why you or no one else would answer my questions, are they too dumb, too hard, or too little information.

Thanks.

i guess 'too long' would be the nearest answer.

This is not my website.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Taxed, this is not specific answer, but maybe you need to read http://www.irs.gov/taxtopics/tc851.html and especially Publication 519, U.S. Tax Guide for Aliens.
There are many options for your case, and you need to try them all to see what you get, keep in mind there is no ultimate option, each will hav econs and pros, depend on how you will continue in USA or Canada.
looks like that you may need also
0806 Form 8833 (PDF) Treaty-Based Return Position Disclosure Under Section 6114 or 7701(b)
as you made money paid by canadian employer in USA
