Can I claim moving expense deduction?

Post by beerd »

HI

I am a canadian. Moved to the states to work on H1B in Oct 2004. I need to file tax return as a nonresident alien. I didn't get any reimbursement for moving from my company. I wonder if I can use moving expenses as tax duduction?

In publication 519 U.S. Tax Guide for Aliens:

Moving expenses. If you are a nonresident alien temporarily in the United States earning taxable income for performing personal services, you can deduct moving expenses to the United States if you meet both of the following tests...

I searched and couldn't find out what personal serices mean. I am currently a network admin in a company. Can I be considered as performing a personal service?

thanks!

Personal services is your employment. This is as opposed to 'independant' personal services, which is contract work.

You qualify.
