Confirming US-Canada Tax Filing 2019

Post by jamesz97 »

Hello,

i am a Canadian citizen from Vancouver and worked in Canada throughout the year with a presale condo that is not yet closed (planning to assign to parents to reduce headache), but left in September 2019 for the US (California) to work under TN Visa.

I wanted to confirm my tax situation and the forms I will need to file:

1. On the Canadian side, I believe I need to input a departure date which is Sept 2019 and I just include the Canadian income that I earned up to Sept 2019.

2. On the US side, I will need to complete
- 1040 NR-EZ, since I did not meet the Substantial Presence Test and have no dependents
- 540NR for California state tax
- Form 8999 since I had an employer contribute to my HSA

3. Is assigning the property to my parents a good idea to reduce the tax headache (NR6, NR4)?

Thanks!

Couldn't seem to find the edit button.

4. I also don't think I need to file FBAR this year since i'm not a US resident yet.

You should file FBAR if you hold more than $10,000 in any account during the year or if they are in multiple accounts, you have to declare all the accounts.

For 1040NR, You have no biz with FBAR.
FBAR is only when you file U.S resident tax such as 1040!

It is correct that you do not have to file 1040 (nor fbar) for 2019.
nelsona non grata. Non pro. Please Search previous posts, no situation is unique as you might think. Happy Browsing :D
