Hi, Nelson, just let you know that I got the Child credit in my case.

The credit and tax refund were electronically transferred to my account. Funny thing is that I did not get the mail for my wife and kids's ITIN yet ( I mailed everything to Philadephia Service Center ITIN UNIT), so I am surprised that the refund is so quickly. Local IRS office told me that I must wait for the ITIN before I can file state tax.

I do not know if it is the final or they will review my file and ask me to pay back the credit.

It seemed that you only need attach form 8833 and tell them you reported world income and ask to be treated as US resident for tax purpose.

Hi octane99,

More than 4 years have passed since your post... I wonder if you'll even get an email with my message.
I am in the same situation, trying to claim the child tax credit based on the treaty even though my kids aren't US citizens or residents.
Do you still remember what you put in your Form 8833? Especially in items 2 (Internal Revenue Code provision overruled by treaty) and 4?
If anyone else would know what to fill, please chime in.

Child Benefit is normally available even if your child or children live in another EEA nation. You can learn more about these particular rules by going to www.dwp.gov.uk and searching for the nation you have left or are about to leave.
