EIN and filing US tax returns

Post by Jrosso »

Hello,

I have a Cnd corp that does some business in the US. I've been asked for my EIN number, if I get that number, does anyone know if I will have to file US tax returns?

thanks!

Getting such a number will not in itself make you taxable in US.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Nelson is correct.

But be careful as they may want your EIN to go on a W-9 form which exempts you from withholding tax, because you ARE saying you are a US tax filer (or otherwise exempt).

If you apply for an EIN, be sure to state it is for "Compliance with IRS withholding regulations" on the SS-4 application. Then, carefully follow the instructions for that choice. The aim is to make sure the IRS doesn't get the wrong impression, i.e. that you intend to file US tax return.

Good luck.
