Canadian working for US Company in Hong Kong

Post by Lane »

Hi:

Am sure this may have been answered, but unable to find through search.

I am a Canadian citizen, not resident.

I was a TN in US for several years, and left in July 2005.From July 2005 till present, I have worked in Hong Kong. My salary has continued to be paid in US.
They have taken full US taxes.

I am working for the same company.

I think that I will be able to get a refund, as a Canadian think I only pay US taxes if I am in US.

I have two W2 forms. One is for time I lived in US. The other is time I lived in HK.

So my questions are:

1)What form do I use for 2005 US tax? I will be mailing it in from HK.
2)Is it clear cut that I don't pay tax for the second W2

Thanks!
Lane

Hi again;

Searched harder and found that maybe I can be a "dual status alien".

Is using form 2555 and using 1040X the answer?

I should add that I will likely return to US in Aug 2006. Plan is to be at least 1 full year in HK. I am subject to HK taxes, and have HK ID card and Hk bank account.

Thanks in advance
Lane
