File a return jointly or separately?

Post by yang »

Hi, ,

I have some questions about US-Canada income tax. I moved from Ontario to US in March 2005, my family followed me from Ontario in June 2005. We are Canadian. My wife and I are on TN, my child is on TD. We don't have Canadian ties left in Canada. We requested non-resident status from Canada Revenue last week.

For Canada tax part, my understanding is that I need to report income tax from Canada source before my family left Canada, using non-resident satus, using Ontario package.

Do I have to report our income from US source (salaries) in Canada tax return? I started work in US in March 2005, my wife started in Semptember 2005.

My other questions are about US tax, I think we are non-resident in US because IRS guide say so. is this right? Which return is better, joint or separate? Form 1116 and Form 2555, which is better for us?
Or do I have to complete both of 1116 and 2555?

Thanks in advance and appreciate your time for answering these questions.

You should file jointly full-year, using 2555 to exclude both your Cdn wages.

For canda, becuase there is a significant time between your departure and heres, your US income until june is repotable in canada.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
