sailing permit

Canadian citizen moving from US back to Canada after extended work under TN visa. Do I really need to apply for a sailing permit with the irs 30 days before I leave or is this process out of date? Seems there is no real enforcement of it unless they find out you didn't pay all your taxes. I am correct in ignoring it, then just fill form 8833 along with 1040NR the FOLLOWING tax year (to avoid IRS taxes on stock capitol gains that I plan to sell)?

I know of no one that has ever filed this, and certainly no Cdn.

FYI, You will not need an 8833 the following year, as your 1040NR will have sufficient places to indicate what you are doing and why you are doing it.
