Child Tax Cred (form 8812) How am I getting a US refund?

Post by KenD »

I just finished up my Turbo Tax and after a full year in Canada, enjoyed the relative simplicity of my American filing (US/Canada dual citizen living in Canada). So I use 2555 to exclude my first $80k, then 1116 to get credit for my Cdn taxes paid. I sort of figured it would work out to $0 and I would happily file it.

However, Turbo Tax produces form 8812 for me which gives me an $850 credit for my kids. Nothing in the IRS documentation says you have to reside in the US to get the credit, but it seems bizarre that the US government would give me anything.

Has anyone else run into the same thing?

I have spoken about this free money in the past, and the issue is becoming well-known. You are entitled to this money even iof you owe nothing to IRS.

HOWEVER:

2 things about your post are problematic:

If you use 2555 to exclude your wages, you cannot get the additional child tax credit.

And, you can't use 2555 and 1116 on the same chunk of income, so you are doing that wrong as well.
nelsona non grata. Non pro. Please Search previous posts, no situation is unique as you might think. Happy Browsing :D

The turbotax interview made me do it!

It looks like I wipe out all my taxes with just the 1116..so I'm going to undo all the 2555 references.

Thanks Nelson! You were a big help to me last year when I moved back to Canada.
