H1b / H4 filing jointly

Post by pradovic »

What are the advantages of filing jointly as opposed to filing separately?

Is filing jointly an option at all for a person in an H1B status, married to a person in H4 status, where H4 person had no income at all, neither in Canada nor US?

H4 - no SSN

Oh yes and BTW H4 persons are not even entitled to SSN, so can/should they file any tax returns in US, whether separately or by being referenced on a spouse's joint return?

As was pointed out, your H4 spouse should file jointly with you, and will be issued an ITIN when you submit a W-7 along with your 1040.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
