Spousal RRSP created by USC for non-USC spouse

Post by MSS1976 »

Hello,

I am a USC with a non-USC spouse (both of us reside in Canada). I created and have been contributing to a spousal RRSP. Do I have any US reporting requirements for this account (FATCA, FBAR)? Or is the account “owned” by my non-USC spouse?

It would be wise to include it on your FBAR as a jointly held account -- and your probably filing FBAR anyways -- since you do have a measure of control over it. Just like a joint bank account that you do not fund, I would not consider it one of your assets for FATCA purposes.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
