401(k) Deduction on Canadian Return — RC267 vs RC268 (Remote U.S. W-2 Employment from Canada)

Post by 93anjutyagi »

I’m hoping for some guidance on how to properly handle my 401(k) contributions on my Canadian tax return for 2024. I’ve read various posts on this forum and understand there are two relevant CRA forms — RC267 and RC268 — but I’m not entirely sure which one applies to my case, or whether I should file both.

Here’s my situation:
• I’m an Indian citizen, moved to Canada from USS in May 2023 as a Permanent Resident, and I’ve been living here ever since.
• I work remotely for a U.S.-based employer on H1B, and I continue to earn U.S. income while residing in Canada.
• I’m actively contributing to a 401(k) plan through my U.S. employer (amount reported in Box 12 Code D on my W-2).
• In 2024, I spent about 40 days in the U.S. and typically travel there every 4–5 months to work from my employer’s office.
• I have no Canadian-source income, but I am filing a Canadian return as a resident.

My questions:
1. Which CRA form should I file to deduct my 401(k) contributions — RC267, RC268, or both?
2. If my software doesn’t support both forms, can I NETFILE and then mail the RC forms separately to the CRA?

Would appreciate any insights from others in similar cross-border employment scenarios. Thank you!
