W-2 and 8833

Post by joeg »

Canadian citizen and moved back to Canada since work visa expired. Continued to be a W-2 employee as they worked on a new work visa and I worked in Canada.
Filled out a 1040NR and OI with a 1040 as a statement for the previous year I was a dual. For the next year filling out a 1040NR and OI where I am claim XV(1) for the whole wage amount as I do not meet resident test as I was not in the US.

I read here 8833 is not required but you can include it and it is better to include it then not but I don't know what to put in section 4 and 5 as none of the services was performed in the US. In 4 I could add this XV(1) again and in 6 break down all the gross income wage, bonus, vacation, etc.

If you file 1040NR, there are sufficient spaces to enter what you are excluding and why. No need for 8833.

In any event, you should be getting off the W-2 regime, and on to either 1099 of Cdn payroll.

Any particular reason it has taken so long to get a visa?
