Hi,
Regarding my special situations, not sure if these questions have been asked before?
Background: Canadian citizen, non-resident of US & Canada. For many years prior, was travelling in
S.E.Asia, & currently residing in Malaysia. Years ago, worked in US, gained a Green
Card, but gave it up when I retired years ago.
For many years prior, my only US sourced income was dividends received from US
companies, and filed 1040NR to report on those dividend incomes & paid tax
accordingly.
For tax year 2023, I have also received US sourced interest from US banks, and have
sold several US stocks with corresponding gains & losses.
Questions: 1) I read from IRS web sites, that non-residents of US do not need to pay tax on US
sourced interest income & US sourced capital gains income. Do I understand this
correctly?
2) If answer to (1) is yes, do I still need to report those interest & capital gain
incomes on 1040NR, based on the 1099-INT & 1099-B forms received, and then how
can tax be avoided, as I am not sure if the tax software I use can handle such situations?
Thanks, catmonk

Re: 1099-INT and 1099-B questions on 1040-NR
1. Correct
2. No need to report.
2. No need to report.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
Re: 1099-INT and 1099-B questions on 1040-NR
Thanks Nelsona for the quick answer.
I have one further worry. Since 1099-INT and 1099-B have been reported to IRS, by not
reporting on 1040-NR form, would that not result in IRS follow-up query to my submitted
1040-NR, as what was on record at IRS would not match to what was reported on 1040-NR.
And worst of all, would that not potentially trigger an IRS audit?
Thanks,
catmonk.

Not likely. They know the rules.

Thanks Nelsona.
One more question if I may.
2023 is also my first year receiving social security payment. I have received a "Form SSA-1042S-Social Security
Benefit statement", which only lists my name & the benefits amount received for 2023. My tax software "Taxact"
asks to fill in misc. information provided by the 1042S form which I have not received, such as income code,
tax rate etc., which are not reported on the Benefit statement.
Question: Where and how can I get a copy of this 1042-S form asap, given that filing need to be completed
in 11 days?
Thanks,
catmonk.

You don;t report SS on a 1040NR, because you are Cdn resident. But the SSA form you got is all you will get.
