Canadian Estate - Executor in will lives in USA

Post by Danielle105 »

My mother past last year. My father is still alive living at home alone with the cat at age 97 in Canada. I understand the estate will be simple in that the assets are limited to the house (approx $400K CDN) and bank accounts (approx $50K CDN). There is no debt.

I have seen the will and I am named as the the executor. The will states, assets will be divided equally between myself and my brother. My brother lives in Japan.

My adult children live in Canada and have been helped quite a bit in recent years. Although not named in the will they have an expectation something will be done for them when my father passes.

I have lived in the USA approximately 30 years and I have not made any firm plans to return to Canada permanently.

I understand it's not desirable for the estate to be in Canada and the executor to be in the USA from a tax point of view. I do not know how onerous this situation is.

From the little bit of research I have done I gather there can be a lot of players involved in an estate. (attorneys, accountants, other firms)

Noting the complexity from a country point of view I am thinking I should have some idea as to how to approach things when the time comes.

Any thoughts?

This issue is probably beyond the scope of this forum, and is likely why you have not received a response. I would suggest that you locate a knowledgeable and competent professional. One particular issue I have been cautioned about is if the estate is in Canada and an Executor is in the US, depending on the state, the Executor's state could possibly claim some jurisdiction.
