3 year limit on Corp-to-Corp

Hello, I am a Canadian consultant living in Canada and working in the US for an American IT consulting company on a Corp-to-Corp agreement (think mid size IBM or Deloitte)

Since I've been consulting for the US company for more than 3 years, the US company is saying that I need to go the W2 route as the US govt considers anyone going corp to corp for more than 3 years as an employee.

Can anyone comment on this please? Also, does this rule apply only to the Americans or are there any exceptions? Considering I do not live in the US and my company is registered in Canada, I am hoping this does not apply to me, so wanted to hear the expert's view on this please.

I immagine you ended up taking a big loss in your pay then? Certainly, corp2corp has so much more incentives.
