TN Visa / working in US and CAN / NR6

Hi

I am a Canadian Torontonian citizen working full time in IT and also as a part time realtor. I am single and has a car and condo. Yesterday I received an offer to move and work in New York under a TN visa. This offer will expirein 2 days!! Although the pay increase is large (in my world) I havent accepted it yet in fear of tax implications. This is because I also want to keep my real estate license while working in US, and rent out the condo.

From reading the many threads, i gathered that once you move to US to live and work, regardless of your residency ties you are a CAN non resident under the treaty.


1. Is there a way to remain as CAN resident? The tax difference between new york and toronto isnt that big. This would allow me to not move any RRSP/TFSA/brokerage accounts

2. Can I be working in US on TN visa but still remotely work for a canadian real estate brokerage?

2. Given that I cannot remain as CAN resident, I would have to file and wait for NR6 approval and pay projected taxes before I can rent out my condo, right? Dont want to hassle tenants to submit monthly withholding taxes.

1. The only way you can maintain Cdn residency is (a) by keeping a full-fledged residence in Canada and (b) living out of temporary housing in US, and frequently commute to Canada.

Otherwise you tip the scales to Cdn non-residency.
You can't move your RRSP/TFSA (you would close the TFSA). You would have to move your brokerage accounts.

2. How are you going to work "remotely" for a Toronto broker? You won't be doing any showings, etc. Fill me in.

3. You MUST remit and pay 25% tax monthly. An agent will have to do this, NR6 is only accepted after you rent out property, only then is withholding reduced. You get excess back at year end anywys, so I would not worry about this.
