US cit(CAD res)married to CAN cit living both in CAN- taxes?

Post by svilena »

Hi, my husband is US citizen and he got CAnadian resident in May 2013. We live in Toronto now.Last year 2012 filed taxes on both places as we didn;t know what to do. This year I am thinking to file just CAD income (not much, below 10K) but don;t know what to do with the US taxes. No properties in US, no income for 2012 (most of the time if not all we were in Canada, no dividents, no RRSPs, nothing, zero. Can we file 1040 with Zero income and are we expected to say where we live on the 1040 form? especially with the Obama health care plan I am getting more and more confused. Me, as a CAD citizen, I let my green card expire so I am no longer green card holder, I just have SSN. Thank you kindly for your time.

US citizens and GC holders must ALWAYS file US taxes, regardless of where they live. And US citizens living in Canada must file in both countries.

Letting your GC expire is NOT ENOUGH to avoid US taxes. You must report this officially to IRS, with proof of actually giving up GC. The expiry date on the card is meaningless.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
