Split ownership and residency status and Cdn property sale

Post by woofington »

A hypothetical question:

If I am a Canadian tax non resident, yet my wife is a Canadian tax resident and we jointly own a Canadian property that is sold.

If the property were solely owned by me then it would be liable for withholding tax, if it were soley owned by there then it wouldn't be.
So what would be the situation regarding withholding tax for joint ownership but with split residency?

Typo: " if it were soley owned by there" should be " if it were soley owned by her"

Half the properry would be subject to non-resident reprting and possible withholding.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
