Hi I need to help in understanding what I can do with my Canadian Tuition once I return to the US.
In 2012 I was employed in the US until April 2012 on a TN Visa. I was still a resident in Canada (In 2011 I filed taxes in Canada and US).
In April 2012 I returned to Canada to go to school so I have a very significant amount of tuition credits available. I attended the university as a Domestic student as I am a Canadian citizen and resident on Ontario.
I will be returning to the US in 2013 and will be employed there.
When I file my 2012 and 2013 taxes with my US income, is there anyway I can claim this tuition?
I plan on filing as a non-resident this time for tax purposes, does this mean I will lose my credits if I cannot use them?
Also, I will be getting married this year and my wife and will be joining me in the US in September. Not sure if that changes anything.

to use any tuition or education expenses in us, your school needs to qualify for US prorams. Check with your school.
also, you would need to be filing full 1040's for 2012 and 2013 to claim these.

I spoke with the university and they said that the school is registered with US Treasury Service, and has a University Tax ID.
That is all the information they had about when asked if they were registered with the IRS and FAFSA.
Would this mean the tuition is eligible?
Also, I am enrolled as a domestic student and paid domestic tuition fees since I am a Canadian. Would that change anything?

Read the various tuition and education credit programs available from IRS, and see if you have the required documentation from the unioversity.
