Canada departure date

CRA has determined my departure date to be September (submitted form NR74) as my family left Canada in September , while I actually left in April. Do I have to include my U.S income from April to September on the Canadian tax and get a tax credit for taxes paid to U.S or simply put my departure date as April and include only Canadian income ?

Unfortunately, yes, you have to abide by NR73. You should not have sent this in.

If you lleft in april, and did not regularly vist canada, you could have put april, but because you filed NR73 -- which goes against the advice of ALL cross-border experts -- you must stich with what they determined.

Thanks, What could be the ramifications, If I go ahead and put my actual depature date - April in my return and Septmeber in my wife's return and not include the U.S income in my return, but only report my U.S income in wife's return (Spouse's worldwide income) i.e I do the taxes as if I hadn't submitted the NR73. If they re-asses are there going to be penalities other than the interest ?.How much of a big deal is it ?. Is there a possibility they will not re-assess ?. Is it worth the risk ?. I don't want to put more amount in RRSPs to cut the departure year tax bill (as there is still time for that for this year).

You proably can't put more in your RRSP at this point anyways since you are non-resident and very few dealers will accept US-resident contributions. You have of course, told your bank, RRRSP, etc, that you left last april?

You sent in NR73. They are expecting you to abide by it.

you can run a version that includes the income and see. It won't be muc extra tax, just more work.
