Departure tax return for Canadian with TN visa

Post by vector »

I'm trying to file my 2011 Canadian tax return. I moved to the US on August 23, 2011 on a TN visa. I had no Canadian income in 2011, no income while living in Canada, and did not own any property or car or financial assets on the date I left. I already filled a 1040NR in the US and received my refund electronically but have not gotten any letters back from the IRS.

Based on other posts, I think have to file a "departure return" for my Canadian taxes, but I cannot figure out what that is. Do I just file a regular Canadian tax return and fill in the box with the departure date? Which other forms, if any, must be filed? Even though I had no Canadian income last year, I think I must repay some of the tax credits I received after leaving (I called the CRA later to tell them I had left).

Thanks

If you do not file adeparture returnn, then you are assumed to still be living in Canada, and thus your USW income from 2011 would be reportable, so file that return.

Yes, you have to repay anyGST CCTB you got after you left

This is clearly expalined in the Smigrants guide from CRA.

Thanks. I understand that I have to file a "departure return", but do not understand what that is and which forms need to be filed. I've read the Emigrants Guide, which said that I just file a General 2011 tax return, but I cannot see where to claim the credit for the taxes paid in the US.

With your departure date, you would not report any US income, so no need for any credits.

But, the general guide explains foreign tax credits sufficiently, should that have been required in your case.
