2 married TNs and W4 filling (line 3=single or married?)

Post by Matt-TN »

We are 2 Canadians living in Florida under a TN status. We both work and live in Florida.

While filling W4 I entered 1 in line A, 1 in line C, so 2 in line H and checked married in line 3.

My wife is debating with me, about the fact that we should fill as nonresident alien and as such check line 3 as single...

Is the nonresident alien (TN) status for immigration the same as for IRS or is it 2 different concepts with the same name ?

You are US tax residents, and have been since the day you moved. You are also non-residents of canada, so should be filing as such with same departure date.

W-4 is not important. it merely determines your withholding. Put single for the first year so that you won't be hit with surprise, since it will take a long time to file.
