First time filing in USA, spouse on TD needs ITIN

Post by klanfa »

Hi,

I'll be filing my first tax return for 2011, and we'll be filing married / joint tax return. My wife is on TD and has no SSN, my understanding is that she'll need to file W-7 to request ITIN. On IRS site they instruct ITIN application to be sent together with a federal tax return. Does that mean I can't file online but have to print my / our tax return(s) and send everything as a package? If so, where do we send this, considering http://www.irs.gov/individuals/article/ ... 09,00.html :

*********************
Because you are filing your tax return as an attachment to your ITIN application, you should not mail your return to the address listed in the Form 1040, 1040A or 1040EZ instructions. Instead, send your return, Form W-7 and proof of identity and foreign status documents to:

Internal Revenue Service
Austin Service Center
ITIN Operation
P.O. Box 149342
Austin, TX 78714-9342
*********************

What exactly are "foreign status documents"? I'm guessing a copy (Notarized? Bank teller stamp sufficient?) of passport main page, TD visa page and I-94?

Thanks

You mail whatever you need to obtain the ITIN. That will depend on what catogory you require the ITIN for, as explained on W-7 instructions.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

I can send whatever they want, what about the address to which to send tax return? It sort of doesn't make sense to send my tax return to ITIN Operations address, but if it is joint and has to be sent together with ITIN application, then it has to go there? I wouldn't want my tax return to be lost in a wrong place...

I don't think the instruction can be any clearer (nor can it make more sense): You send any 1040 that has an ITIN request to Austin, since that is where the ITIN processing has to occur before your 1040 (in which you are requesting an exemption and reporting income in the name of the person needing an ITIN) will ever be worked on.

Where ELSE would you send it?

First time filing so I don't know where this is usually sent, I was hoping to file online using Turbo Tax. It seems this time we'll need to file paper because of ITIN.

Do you know what delays in processing could this cause? I believe tax refunds are received usually within a couple of weeks for online filing?

Thanks
