Dependents Question living overseas.

Hi there,

When filling out the tax return this year I noticed it says dependents living with you.
When it comes to filling out for this year-next year this is our situation.
My husband lives and works in the Caribbean but I will be back in Canada any day with our two children as we are buying a home.
I have only been away from Canada a few short months, my husband has been here since Oct.
How will my husband claim the children as his dependents when they are not living with him because he is away for work ?(no it's not a Canadian employer)
They are definately still dependent on him as I wont be working..

It does not matter that your husband is out of teh country since he became resident in Canada since Oct then you file a CND tax return based on residency wihich means where you intend to reside and report world income since Oct on the return and claim the children ( under 18yrs old) as dependents. The claim will be prorated since you were only resident since Oct for 2010, in 2011 its a full year normal return. You may be able to claim full personal tax credits for yourself and the chioldren if you report more than 90% of your world income on your 2010 tax return, but I think it will not be necessary since you do not work he can claim you as a dependant and teh children since Oct, but you have to do teh math to see if you include world income for the full year as opposed to prorating the claim for the children and yourself and reporting the income since Oct only.
