Abandoned GC this year, can I file 1040NR for last year?

Post by cmyk »

My wife and I are Cdn citizens with US GreenCards (obtained in '05) who moved back permanently to Canada in 2008. I was contracted by a US company for all of 2009, was self-employed for all of '09, and have already filed '09 Cdn taxes and paid the CPP/Self-Employed taxes.

From what I've read, as US GC holders we need to file a 1040 and pay self employment taxes to the US and Canada (basically get double whacked) unless I can come up with a Certificate of Coverage from the CRA.

We recently decided that we're going to make our move to Canada permanent, and since we've already effectively abandoned our GC's by not crossing the border since 2008, we decided to make it official and do the paperwork a few months ago.

So getting to my question...

Can we simply file a 1040NR for 2009 (since we have no GC's to lose anymore) and therefore not have to worry about the self-employment taxes???

No. Get the certificate.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
