Nonresident alien spuose without ITIN/SSN

Post by tsuchiya »

I am a US resident. I am married and my spouse is a nonresident alien (a Canadian citizen) who doesn't have a ITIN or SSN to file MFS or MFJ. Is it a problem if I just file as single? If it's, then how to file as MFS without spouse's ITIN? Obviously, it's too late to apply for a ITIN by April 15. Also, my spouse has non-US source income last year so I don't know if I can claim exemption for my spouse anyway. Please advise.

You CANNOT file single.

When you file your MFS or MFJ, simply attach request for ITIN.

She will need to include her income if she files MFJ, but this will probabaly still be better for you.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Nelena, thanks for the reply.

As for your reply, "when you file your MFS or MFJ, simply attach request for ITIN. " Did you mean attaching a W-7 form?

If I file MFS, and my NRA wife has NON-US source income, can I still claim exemption for her?

If I file MFS and I am NOT going to claim exemption for my wife, is it still required ITIN for her?
