Canadian Deemed Resident, US non resident, taxes

Post by nick0379 »

Hi,

I was working in Canada till Nov 07 and then moved to US under TN-1. I filed my US taxes as Non-resident, 1040NR-EZ. I am really confused regarding the deemed non-resident filing for Canadian taxes, world income etc..

It seems I should have reported my world income while filing US taxes as well, is it true? My income in US from Nov to Dec 31 was more than 10,000 so I cannot be exempted from US taxes under treaty, I think..

Can someone please guide me in terms of dual taxation..

Thanks,

Nick

You are an EMIGRANT for Cdn purposes. Follow the instructions in the emigrant guide from CRA.

The treaty exemption does not aply to you, since you live in US. by filing a 1040NR, you do not report non-US income though.

You could have filed a full-year 1040 reporting world income and taking exclusions and credits, but this would not save you much money.

For canada, file a departing resident return, That should be enough. No US incpme should appear on it.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
