Re-submitting W9

Hi All.

My wife's W9 (ITIN app) got rejected due to not including her name on 1040NR.

How do I go about re-submitting her W9 and modify 1040NR to inlcude her ?

a) at first place, there is no place for spouse name on 1040NR. Guessing - goes under dependants ?

b) should I be able to file 0 dollar 1040NR for her with new W9 app, that would simplify getting her ITIN wihout submitting a copy of 1040x to ITIN office ?

c) or should I go 1040X ( mailing address in Cal ) than attach copy of 1040x and new W-9 app and mail it to ITIN office in Texas ?

d) or do I do it as suggested on phone call with ITIN help line - modify your 1040NR to inlcude her ( with no clear answer where to put here name ), and resubmit with new W9 app

On the notice they states that original 1040NR was forwarded for processing with dissalowed deduction for wife and will be assigned temporary IRC center number !

You need to send a 1040X and resubmit W-7. There is a tax advantage for adding her to your 1040NR, so don't send in a separate 1040NR for her.

Did you check the box in '7' with married to Cdn resident? This was important.

Hi Nelsona,

Yep, on 1040NR checked box 3) Married resident of Canada and claimed exmption box 7A) for myself and box 7B) for wife ! Compared to 1040 1040NR does not have input field for spouse name, and that's where the trick is - I guess. Probably I should have put her as dependant :)

1040x seems like logical solution. What I hate to to is sending 1040x to one address in California, and than copy of 1040x with new W7 to ITIN Texas office - I tried to avoid this much paperwork but it looks it's the only way :(

One thing I don't need is 1040x office telling me that I cannot submit 1040x in this case without valid ITIN for spouse :)

I would send it only to Austin.Do not submit 2 1040X

.. and you probably should have put 'pending' in the indicated space on line 7, not added dependant. There is a space for that.
