US permanent resident, Student in Canada, with US income

Post by babalum »

Hi, i am in a complicated tax situation and need an expert's opinion.
I am a US permanent resident, and moved to Canada in August to go back to school. At the moment I am a full time student in a Canadian university and I also receive research assistantship. I expect this to last 3-4 years and I am planning to go back to US after I finish mu studies.
On the US side, I had a job until August. I still maintain an address and I also contract as a freelance programmer, even though I have not made any income this way in 2007.
So basically, I have a little bit of income from research assistantship from Canada and regular income until August in US in the year 2007. I am filing 1040 and am wondering how I should deal with the Canadian income this year in in the coming years when I have telecommuting income.

Any help is appreciated.

As a US GC holder you will report everything you make to the IRS.

Since you are a student, you are not a Cdn resident, but still must report Cdn income on a Cdn returrn.
if you telecommute from canada, that income is considered earned in Canada.

The IRS will credit you the Cdn taxes you pay, thru form 1116

nelsona, thanks for the reply.
another thing that i am confused about is the place of residence.
i moved from my state of residence (VA) in US in August to Canada. I changed my mailing address to another US state (NY) at the same time. I travel to NY once in a while, but I only maintain a mailing address there. I spend most of my time in Canada.
I understand that I was a part year resident in VA, but I am not sure about NY. What would be my status there? I can see that I need to file VA tax, but how about NY state tax? I am also confused about all the talk about being bona fide resident of another country. Could somebody shed a light?
Thanks

Usually international students are not considered residents of the country they go to school in.

as to your state, you were probably never resident of new york, but I'll let you figure that out.
