Sailing permit and/or 1040-C

Post by cantousa »

1. Is Sailing Permit same as 1040-C form?
2. I read somewhere that Canadian citizens are not required to file a 1040-C. Is that correct? If so why?
3. Assuming a Canadian citizen is not required to file a 1040-C, is it the case when a Canadian citizen who is a U.S resident is permanently leaving the United States - First moving to UK for 2 years to live and work there and then move to Canada.

Thanks.

I've nerer heard of a Cdn being told by IRS that they must file a 1040-C or sailing permit. It doesn't matter to which country you go, as long as it is a treaty countrry.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Nelson,

Thanks for the reply. I was also saying that I heard Canadians are NOT required to file a 1040-C. You confirmed that is the case, but with a qualifier "It doesn't matter to which country you go, as long as it is a treaty country"

I am in the US on a TN visa and I plan on relocating to UK for two years to live and work there. From there I plan on returning to Canada. I need to know if I should file a 1040-C before departure. Is UK a treaty country?

Could you perhaps point me to a section in the US-Canada treay where this is covered? Because, looking at 1040-C, it does not say anything about Canadians not requiring to file.

Thanks.

UK is a treaty country. And you will still be Canadian, so are covered both ways.

Thanks. Sorry to keep repeating myself. Could you point me to a section# in the US-Canada treaty which says this? Thanks.

XXV. Cdns cannot have anymore burden on them than US citizen.

Since a US citizen does not have to file a 1040-C, nor do you. Same language in the UK treaty.

Stop fretting.
