Hello, I'm a Canadian citizen married to an American citizen. We are moving to Canada soon to reside permanently - my husband already has his PR card.
My husband's income is from a "structured settlement" The periodic payments are non-reportable and non-taxable in the US, and they are non-taxable in Canada as well. This we have already ascertained.
Question: when I file my own T1 return, what do I put on the line that asks for my spouse's income? If it is non-taxable, do I put "0"? Or, if I report it on that line, do I have to explain what it is and its non-taxable nature so that CRA understands?

Maria, as far as I know "structured settlements" are not only tax exempt but also NOT reportable, so I would not put that part of his income on your own tax return, where they ask, only whatever else he has by way of taxable income...but to be absolutely sure, check with any law firm that specializes in structured settlements IN Canada and see if they receive the same treatment as in the US.
If so, it would fall under the types of income not to be reported because it's from an ally country and it's not taxable there.
