Ok....thanks Nelsona.

I just thought I read somewhere on the IRS site that individuals that filed 1040NRs still have to include 8938s and 8891s.

So my question is i suppose answered.

I will ask it again;

Do I attach one copy of 8938 and 8891 to the 1040/1040NR package, or is it a requirement to attach an additional copy to the 1040NR?

I will ask this question a different way. I relinquished my US citizenship in December of 2012... I have to fill out a 1040 and 1040NR. I understand that I attach my 8891 and 8938 forms to the 1040, but for the 1040NR do I also have to attach the same forms? If so are they just duplicates of the one...

Nelsona...i looked up that treaty article and it specifies:

This Convention is generally applicable to persons who are residents of one or both of the Contracting States.

If I have never resided in the United States, would this article still apply to me?
