Re: Child Tax Credit
Thanks again Nelsona. I'm sorry to belabor this , but....... Line 4 on the 8812 asks for the number of children who have SSNs, so none in our case. Line 6 asks for the number of qualifying children who do not have SSNs but cautions not to include any child who is not a US citizen, US National, or US...

Re: Child Tax Credit
Thanks Nelsona. Just to clarify, though. Form 8812 is the normal form for Child Tax Credits....is there no need for a form stating that the child qualifies because of Canadian residency ? ( Or does the W7 form meet this purpose ? , per item 2 below ) Also, 1. Line 4 says to count only children who h...

Child Tax Credit
Scenario........a Canadian couple with two children move to the US in August. They don't meet the substantial presence test at the end of the year and file 1040NR returns. ( They are aware that they could use the tax treaty to file full year returns but choose not to do this.) Since their children a...

Re: Article XXV 1040NR no longer allowed?
Sorry, just learned that XXV (4) was renumbered to XXV (3) in 2007.

Re: Article XXV 1040NR no longer allowed?
This case is indeed convoluted. I'm just learning about all this stuff but here are some thoughts. I would be happy to be corrected if any of this is incorrect. In the 1980 tax treaty I believe it is XXV (4) which allows a married non resident to file a 1040 on a joint basis on his full year income....

First year immigrant taxation
I'm back researching taxation for my daughter and her family who recently moved to the USA. It has been quite an interesting exercise. They arrived in the USA on July 26 and so will not meet the Substantial Presence test at the end of 2022. This means that their base case is to file individual 1040N...

Re: W8 versus W9
Thanks everyone. Just to probably close off this discussion, to respond to your last three posts Nelsona..... 1. Perhaps a pragmatic approach would have slid by the issue. But when you are new in a country where the tax authorities have a reputation for being a bit tough to deal with I can totally u...

Re: W8 versus W9
Nelsona.....well this all started when she submitted a W9 to a US bank where she had opened an account. They rejected it because of the issues we are discussing. Maggie.....thanks very much for these helpful links. But......unless I'm reading them incorrectly I think they confirm that she is not yet...

Re: W8 versus W9
Thanks Nelsona. However, I am still a little confused by this..... Item 3 of Part II, Certification of the W9 form certifies that the person signing the form is " a US citizen or other US person ". The instructions below the form say that this means you are a US person or resident alien. H...

W8 versus W9
My daughter has recently moved to the US. Her husband has an H1b visa and she and their two kids are H4s. She has encountered a fair amount of confusion from both Canadian and US financial institutions regarding her residency status. She is no longer resident in Canada but she will not qualify as a ...

Use of existing SSN
Further to my last post asking about ITINs.... In 1995 I was working for a couple of years in the USA. My daughter was aged about 10 at the time. We were all given SSNs , including her. I have the card still ....it says ' Not valid for employment ' but otherwise is a regular SSN card. She has just m...

Re: W9, W7, and getting an ITIN
Thanks Nelsona. You made me smile with your comment that it might be hard to make any progress before her tax filing next Spring. Ax you say, H4s are second class. If fact, my daughter has said that the system more or less regards her as an undocumented alien. I do have another question about her si...

W9, W7, and getting an ITIN
My daughter has recently moved to the US. Her husband has an H1b visa and she and their two kids are H4s. She has investment accounts in Canada and the broker is asking her to complete a W9 form. The W9 asks for an ITIN which she does not yet have. The form instructions say that if you do not have a...
