Thanks for your reply Nelsona. Once, I obtain the effective tax rate from 1040 (line 63/line 37), would I multiply that with the Ajusted Gross Income (line 36 on 1040 NR) to calculate the net tax (line 58 on 1040NR) ?

AMT?

If we choose to file 1040 using Article XXV, do we have to file the AMT form (Alternative Minimum tax) as well? Last year I filed 1040NR and was asked by IRS to fill the AMT form......so if I file using 1040 this year, I am paying atleast 4K-5k less taxes to US....Isn't that going to raise a red fla...

I am sorry but I don't understand what you mean Nelsona. Form 8833 requires a US address, can I still use it to take advantage of Article XXV?

if I amend my canadian taxes, can I go back and invest in RRSP's for those years? If not, whatever I save on US taxes, I will end up paying to Canada. So, is there any real advantage in amending the taxes for previous years?

How do you notify the IRS that you are filing 1040 NR but using Article XXV(4) ? I have been filing simple 1040NR for the last 5 years......wouldn't the IRS smell something fishy when I do it the other way this year......I could possibly save atleast 3 to 4K in taxes this year.......does it make sen...

Thanks....Isn't it better to file 1040 instead of 1040NR as the tax rates are lower in 1040?.....1040NR tax tables have no provision for married-joint filers.
