Hi Nelsona,

I go to US to work and come home every other weekend, sometimes i work from home 1-2 days in two weeks and thats all.
The sole reason of been in the US is because of my job, i keep an apartment there where I stay when I go to the U.S and thats all

Thank you for your response, then I would assume that these forms are to be filed ONLY when I meet the presence test - in the U.S more than 183 days and i still claim a closer connection to a country that has treaty agreement with United States.

I would like to know when I should file any of these forms. Thank you Nelsona for your response. Well, on 1040NR, I did not claim Medicare and Social security as I was made to know this is my CPP and EI in Canada and wasn't supposed to be claimed on 1040NR. I work in a state with no state taxes, so I filed 1040nr and got refund on the taxes I paid on income....
