For 1040NR, You have no biz with FBAR.
FBAR is only when you file U.S resident tax such as 1040!

You should file FBAR if you hold more than $10,000 in any account during the year or if they are in multiple accounts, you have to declare all the accounts.

Called CRA today and response was that, for the period you are non resident, you need to file separate section form 216 to recover some of the withholding fees.
Hope this helps for people who needs to know.

I will file 1040 MFJ, just want to make sure am using the right form based on my situation.
Sorry for bringing up Article XXV, but what i meant to say is that I have always filed 1040NR in the past despite meeting residency but use treaty 8833 form as I wasnt a GC holder then.

As long as one doesnt call these accounts as trust account, he has no reason to file 3520 or 3520-A and as such is off this hook of 10k fine randomly going around.
