But how can I be a resident alien? Are you suggesting I just pretend that i am? I really have not met the substantial presence test.

How long in advance of your start date is it acceptable to enter the US on a TN visa? My start date is late September but I'd like to go in early September. Is this a problem?

I'm moving to the US in September with a TN visa. I want to be considered a deemed non-resident for tax purposes so I file an exit return for 2012 in Canada and a resident return in the US. Do I need to meet the 183-day requirement for this? I haven't calculated it to the day, but it should be close ...
