Does the situation change if the employment agreement refers to me as an employee vs a contractor?

Canadian resident, 90% remote work for US firm

Hi folks,

Apologies for beating a dead horse. I am a Canadian resident, planning to work for a US company, 90% remotely, but 10% in the USA (and not just meetings, and sometimes for a few weeks, but never more than say two months of the year total).

Is this a workable plan:

foreign contractor ...

I'm single and in quite a high tax bracket, relatively. I would have to check, but I think it's around 45% for federal + state + nyc.

I still think before returning to Canada, it would be worth rolling everything into a Roth IRA -- if I have some flexibility over when I move, would it be possible ...

Also, I assume this but haven't checked -- I opened a TFSA in Canada as soon as they were created. I presume this has been growing in "potential contribution room" but I haven't actually funded it.

a) I should not fund it now, while I am a US tax resident?
b) will it have been growing in ...

After-tax 401(k) (not pre-tax or roth)

Hi all,

Here's the situation:

36, Canadian, living in the US now for the last two years, intend to stay here for another two at least, possibly another five.
100k in RRSP, 36k in a pre-tax regular 401(k)

I just heard about "after-tax 401(k)" contributions, where I could contribute an additional ...

It sounds like I might be getting a $2500 penalty for not filing a T1161 when I left. Are there any other time-bombs like this I need to be aware of?

Is that all, or do I need to file anything else as well? (thanks again)

Gotcha, thanks. So, now, at the time this is being dealt with (ie: Promise to Purchase, notary at the end of the month), I should file a T2062 (with a T2091?)? Do I need to file a T2062A since I briefly rented it?

Just trying to figure out all what I need to do "in the next 10 days"...

To clarify, I didn't file a *Canadian* tax return in 2011, as I had only US income, and the Canadian rental income didn't begin until 2012.
