nelsona, appreciate very much for your advice! As per your answer, as long as one files 1040 joint, he is a US person and he must be compliant with FBAR regardless his citizenship and his residency. JGCA, thank you very much for your detailed instruction!

I have now understood the steps for fixing my 8891 and TD form issues. Just for your info, I have just checked and found out that my accountant filed 8891 for me for 2007 so it started in 2007.

Sorry, I found the answer in the 8891 instruction:

"A beneficiary who previously made the election to defer
income on the plan or is making it initially by checking the
box on line 6c must only complete lines 1 through 8 of the
form."
