New process for TN1 visas?

My husband was told by a prospective contract employer for a corp to corp job that they do not do TN visas anymore because it isn't just that they provide a letter to my husband to present at the border - they said they have to send a letter directly to immigration and get the approval prior to him ...

Thanks Nelsona, it was that triggering taxes in us for this year I was most concerned about, but it seems that if he does w2 in 2017, the dots won't connect.

Canadian on IT contract with TN

My husband has been in California on a TN since June, on a corp to corp basis so our corp in Canada is directly paid with no with-holding so clearly in this case he is a non-resident of the US. The contract is for 6 months only. However, he has been offered another contract for 1 year in New York St...

Ok, thanks. No, he's never had to do a letter re social security because the billing is done directly from our corporation, not as an individual. Nor is it 1099 when done that way since he isn't a self-employed individual.

Thanks. What do you mean by SE? And by a letter from CRA regarding compliance - what kind of letter do you mean? That we pay taxes in Canada? We always file a W8BEN with the client though, to enable them to not deduct any withholding.

TN work - if more than 6 months

My husband is about to accept a contract in the US. We have a Cdn corp and have done corp to corp before but if this contract is for longer than 6 months, is it better that he go W2? Should the client deduct US payroll taxes at source and if so, how much as a NR of the US. I will remain in Canada an...

Thank you. What if we also sell a 6 month subscription for our software product to the end client, which will be a separate invoice from a separate cdn corp. The product is a download that expires after 6 months. We'll be billing in US dollars.

Canadian Corp paying US corp for work performed in US

This is the opposite of most questions but our Canadian Corp will be putting together a team for some IT projects in the US. A couple of the members of the team will be US individuals who have their own corporations to invoice from. They will be invoicing our corporation and we will be invoicing a U...

Ok so a W-8BEN or W-8BEN-e? I understand that now a Canadian corp has to use the W-8BEN-e or am I wrong.

Canadian IT Contractor TN work in US - best tax approach

Even if someone is an owner of a Canadian corporation, it is best to work in the US on a TN as an individual and have taxes deducted at source then file a NR tax return these days with all the complications of going through a corporation and the tax rules that apply to that? The person working in th...

The idea is that the US staffing company that is currently paying the Canadian Corp would instead pay the US LLP and the partners take out the money and pay US taxes on it. But since my husband is in the US on a TN visa, I don't think this will work. Someone on a TN can only work for the sponsor com...

Canadian IT Consulting corp use an LLP in the US?

Is an LLP (in Texas) an acceptable vehicle for an Canadian IT consultant on corp to corp contract in US (and considered an alien resident) to run revenue through and pay US taxes? The Canadian corp and the LLP would both be owned by the same 2 people on a 50/50 basis. How would this compare to, say,...

He has been in and out of the US and has only been there this time for 2 months (in the last 12 months). However, the client wants him long-term. It isn't a problem to start paying taxes in the US, and its not even a big factor to lose the health care since I can get it in Mexico, but I am assuming ...

Factors affecting Canadian Residency status

If husband works and lives in US more than 183 days on TN, but owns 2 Canadian corporations and house in Canada and I live much of the time in Mexico with 2-3 visits to Canada of several weeks each, will we be deemed non-residents of Canada for taxes and health-care? We have been renting out the hou...
