With all due respect, I think qweryt is wrong. I believe you should file to Austin, TX address. Because at the end of the day your wife is Dual Status Alien choosing to be treated as resident and 1040 instruction is clear that Dual Status Alien should file to Austin, TX. GST/HST credit taxable in US ?

Hi, Last year I received GST/HST credit in Canada. Now filing US return as US resident. Are they taxable income in US ?

First, Thank you for your prompt answer

Second, I apologize again if it bothered you. But by saying I didn't mean that, I didn't mean “â€￾the keys accidentally slippedâ€￾. If you look at how I write English, It should be very obvious to you that I am not a Native English speaker (though Cdn Citizen). Most of the time, I try to use what is grammatically correct without understanding its harshness. In English -as I know and I am not a native speaker- when you call someone's name, you use exclamation point in front of his/her name and it is not rude or anything. But it seems that it is not practically friendly, so I will not use that any more. Thank you for letting me know that. And this is what I mean by “I didn't mean thatâ€￾. This is another problems of being immigrant and talking in language you can't sense it. But at the end of the day, this is my problem and I am sorry for that.

Third, Could you plz clarify your third answer. She never left US throughout 2010. Having said that, you mean she still needs to put her “fullâ€￾ Egyptian address ?

ITIN for Spouse of a Canadian who is nonresident for US tax

Hello to all :) ,

I am a Canadian citizen and Canadian resident for tax purposes. I am currently in my forth year in US on F-1(student) visa and considered Nonresident for US tax purposes. I have received $30000 stipend from school here in US and I need to file 1040NR. The complexity comes from my spouse who is with me here in US but she is neither a Canadian citizen nor a permanent resident of Canada. We married in Egypt two years ago and she came to US with me on F-2 visa (dependent of student). I am not sure but think that as a Canadian citizen I can choose “Married resident of Canada or Mexico or married U.S. National â€￾ filing status on 1040NR claiming spousal exemption on 7b of 1040NR and apply for her ITIN on W-7.
But there are some confusion hoping you can help:

1. Am I correct that as a Canadian citizen being nonresident in US I can claim exemption for my spouse despite the fact that she is not Canadian citizen/resident? Do you think that our application my reject because her country of residence is not Canada?

2. On W-2 form, should she choose item g for theâ€￾ reason you are submitting Form W-7â€￾? --- Item g is Dependent/spouse of a nonresident alien holding a U.S. Visa .

3. And finally the biggest confusion: For foreign address on W-7, should she enter just Egypt or complete address. Some says that If she enters complete address, because we were on F1/F2 visa and I need to show she has been with me here in US, they will reject the application and I need just enter the name of Country she last resided in before coming to US. But I think she is nonresident for taxes and so she needs to maintain address in foreign country. And I -as a resident of Canada- can claim my spouse wherever she is. Please tell me along with US address, what should be put for foreign address.
