Now IRS just post the new rule for RRSP. Automatically defer income, and eliminate the 8891 retroactively? But 114A and 8938 still apply.

Thanks Nelsona. Since it is intentionally transfer assets to avoid filing requirement or tax when he as a resident, just want to make sure there is no restriction on this tax planning.

For US side,

Your canada company, 5471 Form, TD F form

Your personal, 1040, TD F

You fill out w-9 to US company.

But I bellive US company should pay salary to you directly based on your TN Visa.

I have some question about residency and assets transfer before that. EB 5 (investor immigrant visa) holder, wil not enter US until next 2013, and will not get physical green card until he arrived in 2013. Does it mean in 2012, he is still nonresident foreigner and could transfer /gift any assets to...

Nelsona, but he got his GC at Apr, and Activie it in Aug. Once he has the GC, he is the resident of US I believe. Ane exception from IRS you know?

For Schedule B, if only a box that not checked, I believe it is ok because there will no penalty be posted on this issue. IRS jsut want this to cross check the other forms, 3520, TD F...
