Another problem - how do you enter as contracotr? This would make one nervous after reading CBP WebSite - pretty obvious statement: https://help.cbp.gov/app/answers/detail/a_id/978 In order for Canadian citizens to apply for a TN visa, they must first obtain proof of a job offer, in the form of an e...

Interesting, good idea, just do as contractor, which is basically the same thing that I would be doing. Nelson, can you give me a hint why it's better this way? Can I give customer my business name as proprietor and then fill out 8233?

Thank you!

RE: "To enter on B1, you need to be employee of Cdn company." Does this play a role if you are: 1) Canadian corporation with 100% shares ownership 2) Canadian Sole proprietor with 100% stake? In both cases you are employee of your own Canadian business, but how do they look at you when ent...

Canadian resident registering Corp C in US

Just looking at different ways of doing business in US while remaining Canadian resident. What's going to be tax picture if Canadian resident incorporates in US: 1. US company will be resident of US and pay all US taxes. 2. It will pay salary to Can resident who is in US for less than 183 days so wi...

TN, B1 and Taxes

I understand that it doesn't matter if you are on B1 or TN visa, taxation is different subject. You can face taxes or be exempt as B1 or TN. You can enter on TN and still be subject to US-CAN tax treaty and be excempt. Is this correct?

Thanks Nelson! Yes, I knew I am not subject to US tax, but I wasn't sure if I am not subject to withholdings. So for example I could be loosing 10, 20, 30 % of every pay and then submit return to IRS to get it back. But apparently what you are saying is there will be NO withholding and NO TAX. In ot...

I am confused. Will you be subject to withholding or not if you are sole-proprietor? And if you do - maybe an answer is to incorporate in Canada? Or even in US?

Self-Employed Canadian working in US - Withholding?

As Canadian resident, sole-proprietorship performing consulting services in US (no fixed base) and paid by US company, would any withholding apply? There seem to be contradiction: http://taxes.about.com/od/taxplanning/qt/form_W8BEN.htm The tax treaty specifically allows for US companies to withhold ...
