My input: Yes, the 3520 and 3520A are sent to a different address then the 1040. Yes, they are due the same day as the 1040. Yes, yearly income from 3520A should be reported on the 1040, even if you didn't have a distribution (withdrawal from TFSA). The TFSA is not a tax-free account in the US after...

Yeah, looks like to me you should put the distribution value in 3520A on lines 17a and 17b. You are the owner of the TFSA afterall.

No need to fill out 3520 Part III

Wow, thanks everyone for the great info in this thread! I think the first post on this thread is spot on (except that most TFSA's won't have a US Agent). There was some discussion on where to report distributions (withdrawals from TFSA's). Some posters thought it should be recorded in form 3520 in P...

Some quick answers to your questions... We rented in the US in 2009 and 2010 because we didn't expect to stay in the US long-term. We didn't close any Canadian accounts, didn't rent out our home, and I was working remotely for my Canadian office, doing my exact same Canadian job, being paid in Canad...

Thanks for your clear answer! I really appreciate it! Thank you for answering my questions. You make a good point about the Closer Connection I sited. Perhaps I was wrong. I am trying to retro-understand how KPMG filed our taxes for 2009 and 2010. They did not point me to those links, that was from ...

We had KPGM file our taxes professionally in 2009 and 2010. Yes, they filed Form 8833 to indicate that the treaty tie-breaks us to Canada. See IRS link Conditions for a Closer Connection to a Foreign Country (http://www.irs.gov/businesses/small/international/article/0,,id=96377,00.html). We maintain...

How are capital gains taxed in US Dual-Status Alien year?

This seems like a chicken-and-egg problem for us... First, some tax history, as it's an interesting one. We are Canadians working in the US. My husband and I have slowly become more committed to staying here and we have finally decided that Tax Year 2011 will be the year we officially depart from Ca...

Income taxes in Canada are LESS than the US!

What a surprise! My husband and I are from Vancouver BC but we have been working in Boulder CO on TN Visas with a Per Diem housing allowance. A tax consultant told us that it would be better to remain a resident of Canada for tax purposes during this time to take advantage of a foreign tax credit (o...

Yes, you are right! Sorry, I'm really new at this! The Gov of Canada website says this: "You become a deemed non-resident of Canada when your ties with the other country are such that, under the tax treaty, you are considered a resident there." http://www.cra-arc.gc.ca/tx/nnrsdnts/ndvdls/n...

This article implies that it's possible to be a resident in both countries. http://www.irs.gov/pub/irs-pdf/p597.pdf "Article IV provides definitions of residents of Canada and the United States, and provides specific criteria for applying the treaty in cases where a taxpayer is considered by bo...

Working in US, better to have US vs Canadian residency?

Hey Guys! I was wondering if people have any insight into the advantages/disadvantages of working in the US and keeping/losing Canadian residency? My husband and I are currently working in the US on TN visas and we have kept our Canadian residency so he can take advantage of some Foriegn Employment ...
