OHIO & MICHIGAN TAX RETURN - NON RESIDENT

Im a Canadian Resident working in the US under a TN. In 2009 I spent half year working in Michigan and half year working in OHIO (two different employers). An electrician takes a job out of town commuting each day (200KM round trip), his employer provides a Form T2200E (declaration of conditions of employment). Would he be entitled to deduct fuel expenses associated with his commute?

Does TN status require sponsorship?

often times US employers will ask if you require sponsorship to work in the US. As a current TN holder - finance professional - CA and CPA covered under NAFTA, employee provided a letter of employement - does this constitute sponsorship? Just trying to understand whether, when the employer askes if ...

Hopefully an easy one? I'm a Canadian resident commuting to the US on a TN visa. I have elected to participate in my US employer medical plan, my only option (as HSA where not eligible for non US residents) was a $5K/year PPO plan. My wife is self employed working from home, I've historically claime...

Non Cash US charitable donations - CDN deductible?

I'm a Canadian resident working in the US under a TN Visa. I've recently heard that there are charities in the US that will issue tax receipts (self assess) for donations (other than cash, clothes for example). I understand that in Canada donation receipts are not issued for "most" non cas...

To Claim or not Claim on 1040NR?

I'm a Canadian working in the US on an TN visa commuter. A number of other Canadian Commuters have advise me to obtain an ITIN number for my family so I can claim them as dependents on my US tax return. My thoughts are why bother, when at the end of the day I'm going to pay Canadian taxes to the ful...

Roth IRA vs Traditional IRA & Canadian Taxes

Any thoughts on structuring company match 401K in a Roth or Traditional IRA, and whether one would be more beneficial in terms of how the CRA would treat them on initial investment & Upon Withdrawl. I was hoping to see some favorable tax rule changes in the recently approved federal budget surro...

During 1996-2001 these contributions to 401K were in fact reported as earnings in Canada (W2 and T1 to support). Living in Canada the entire time At the time the 401K was withdrawn. It was NOT reported on the 2003 Canadian tax return, with the understanding that it had already been tax. (ie. persona...

Thanks Nelsona, We spoke with the CRA Foreign Reporting today who have advised they will assess the 2003 full amount withdrawn from the US on the Canadian return and it will be our responsibilty to appeal to a different division to have the taxes refunded, based on the contributions to 401K already ...

NON REPORTING OF 401K Withdrawls

While working in the US between 1996-2001, 401K contributions made were not deductible in Canada (therefore the monies were essentially tax paid dollars in Canada). In 2003 after returning to Canada to work the 401K dollars were withdrawn well below the age the 65, the value of the withdrawl includi...
